In other words, doing something that a reasonably careful person would do under like circumstances, or failing to do something that a reasonably careful person would do under like circumstances.

There are two primary ways to prove fault in a car accident:

  1. Police report – After an accident, the police will perform an independent investigation. The investigator will determine fault based upon the physical evidence and interviewing all participants of the accident including all drivers, passengers, and any eyewitnesses.
  2. Traffic laws – If a driver violates a traffic law, that violation is evidence of negligence.

How does insurance come into play?

In evaluating a personal injury claim, one must first determine the amount of insurance coverage the at-fault driver has because the at-fault driver’s insurance coverage is primary. If the at-fault driver has little or no insurance coverage, we need to determine if you have elected to purchase “uninsured/ underinsured motorist” coverage commonly referred to as UM coverage. If so, your UM coverage would step into the shoes of the at-fault driver.

Additionally, every motorist is required to have Personal Injury coverage commonly referred to as PIP which pays 80% of your medical bills and 60% of lost wages, irrespective of fault, up to a minimum amount of $10,000.

What should I do after a car accident in Palm Beach County?

  1. Move to safety – If your vehicle is drivable, move your car off of the road to a safe space and turn on your hazard lights.
  2. Call 911 – Call the police so that they can investigate the car accident and document the names and addresses of all drivers, passengers and eyewitnesses. Be cooperative with the police officer and assist him/her in determining who was at fault.If you are injured or are experiencing any pain, advise the police officer and request an ambulance. If necessary, go to the emergency room or an urgent care facility. If you do not seek medical attention within 14 days of your accident, your PIP coverage will be limited to $2,500.
  3. Take photographs – If possible, take photographs of the accident scene. Also take photographs of the property damage sustained by your car and lastly, take photographs of any visible injuries
